Software End-User License Agreement

END-USER LICENSE AGREEMENT

This User Agreement (hereinafter, the "User Agreement") regulates the relations between the manufacturer of the software (hereinafter, the "Software Manufacturer") and the individual or legal entity acting as the end user (hereinafter, the "User") regarding the use of the Kerish PC Doctor software product (hereinafter, the "Software").

1. Subject of the User Agreement

1.1. The Software Manufacturer offers the Software to the User under the terms specified herein.

1.2. The Software Manufacturer may change this User Agreement at any time without notice.

1.3. If the User continues using this Software after the User Agreement is updated, in so doing the User accepts the changes made to the terms of this User Agreement.

2. Entry of the User Agreement into Force

2.1. The User Agreement enters into force when the User agrees to the terms by checking the box "I accept the terms of the Agreement" in the form containing the text of the User Agreement in the Software installer.

2.2. If the User disagrees with any of the provisions hereof, he/she must terminate installation or use of the Software.

2.3. Installation and use of the Software by the User means that the User agrees with the terms and conditions of the User Agreement and undertakes the obligations described herein.

3. Description of the Services

3.1. The Kerish PC Doctor software product for personal computers is intended for the automatic maintenance of a computer. The Software prevents failures, corrects errors, deletes "trash" files, optimizes the performance of the computer, and protects it. The User may enjoy the Software for free during a trial period of fifteen (15) days from the moment it is installed on the computer. Pending the trial period, the User may order Paid Services under the terms hereof.

3.2. Paid Services include the provision of an license key (code) (hereinafter, the "License Key") which enables the use of the Software after the trial period.

3.3. If the Software is purchased on a tangible medium, the License Key validity period is indicated on the package or in the supplementary agreement. The User may use the License Key for the number of devices indicated on the package or in the supplementary agreement.

3.4. If the Software is purchased online, the License Key validity period is indicated during the purchase or in the supplementary agreement. The User may use the License Key for the number of computers indicated during the purchase or in the supplementary agreement.

4. Ownership

4.1. The Software Manufacturer provides the User with the personal non-exclusive and non-transferable right to use the Software on the condition that the User observes the terms hereof.

4.2. The User acknowledges and agrees that the Software is protected by copyright, intellectual property laws and other respective international laws.

4.3. The User bears civil, administrative, and criminal responsibility under the effective laws for violation of the intellectual rights for the Software.

5. Limitations

5.1. The User shall not decompile, disassemble, modify, or perform derivative work based on the Software, in whole or in part, except as otherwise provided for by law.

5.2. The User shall not sell, resell, rent, lease, or use any parts of the Software for commercial purposes, except as permitted by the Software Manufacturer.

5.3. The User shall not provide third parties with access to the License Key. The User's License Key is confidential. The Software Manufacturer recommends keeping the License Key in a safe place while it is active.

5.4. The User agrees that the Software Manufacturer may block the User's License Key, and by doing so cancel the Paid Services if the User violates the terms hereof.

6. No Guarantees

6.1. The User understands and agrees that he/she uses the Software at his/her own risk. The Software is provided "as is". The Software Manufacturer and its authorized agents do not incur any liability for the compliance of the Software with the User's goals, proper functioning of the Software, data loss, damage, and direct or indirect losses caused by using or failure to use the Software.

6.2. The User shall be held liable for any damage that may be inflicted on the User's computer and data through the use of the Software.

6.3. The Software Manufacturer will not be held liable in any way under any agreements made between the User and third parties.

7. Confidentiality

7.1. The Software Manufacturer guarantees the User's absolute confidentiality. The Software shall not collect or transfer the User's personal data.

7.2. For the purposes of checking the legal use of the Software, the User shall provide the Software Manufacturer with information on the License Key should he/she acquire one.

7.3. When activating the Software with the License Key, the User agrees to provide the Software Manufacturer with information contained in the computer's unique ID concerning the serial number of a component of the used device.

7.4. To facilitate the identification of new threats to information security and to increase the level of protection over the information stored and processed by the computer User, the User agrees to provide the following information about potential malicious objects selected by the User or recognized by the Software: the name of the file, the name of the developer indicated in the file properties, the name of the software indicated in file properties, and MD5 checksum files.
